(Including RETURNS Policy) for INNOVATIVE NAIL KREATIONS LTD (hereby referred to as ´INK´)

 

The INK website is owned and operated by INNOVATIVE NAIL KREATIONS LTD, UNIT A, 3A UNDERBANK WAY, ROSSENDALE, BB4 5HR, UK (Registered office) – Company registration number 08742616. See our Contact Us page for our contact details. These Terms and Conditions govern your use of the inknails.com website and your relationship with INK. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the INK website. By using inknails.com you agree to be bound by these Terms and Conditions. Nothing in these Terms and Conditions affects your statutory rights.

 

You can order products in the following ways:

When you place an order for a product in any of the ways described above you are offering to buy it for the price stated, subject to these Terms.

When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order. Once we have sent the confirmation email we will then check availability and contact you if the product is not available you will be notified by email.

´INK´ may cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled, any payment made for the products will be refunded in full. This does not affect your Statutory Rights.

Payment

Orders may be processed online using paypal, credit or debit card (Visa and Mastercard credit cards, Visa Delta, Switch and Solo debit cards).

To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet. All transactions are directly between yourself and the bank. Not only do we not store your card details, we actually never have access to them (client to bank direct) – Security is our priority.

Your credit card company may also do security checks to confirm it is you making the Order.

All order details and invoices will be sent via email.

Price

The price for each product on inknails.com is shown in UK sterling and excludes VAT. Prices shown in other currencies are a guide only for your information, all payments will be taken in UK Sterling.

We always try to make sure that the prices on inknails.com are accurate but errors may occur. If we discover an error in pricing of the Products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you we will treat the order as cancelled). If an order is cancelled, any payment made for the Products will be refunded in full.

You will be notified of the delivery costs automatically before you submit your credit card details, based on the delivery address you specify.

Acceptance of your order

There will be no contract of any kind between us unless we actually dispatch the products to you. Your order (including payment) is an offer to buy from us, so nothing we do or say will amount to any acceptance of that offer until we actually send the product to you. At any point up until then, we may decide not to send the products to you and to give you a full refund. At the moment the goods are dispatched (and not before), a contract will be made between us.

Delivery and Charges

The cost of packing and delivery is clearly displayed at the checkout for your approval prior to confirming your order. If your order meets the ´FREE DELIVERY´ threshold you will not be charged delivery. However, should you subsequently decide to return an item to us for a refund and by doing so this means that your revised order total is inferior to the free delivery threshold then we will charge you for the delivery. Please keep this in mind.

Most orders placed before 2.00pm (Monday-Friday) will be delivered on the next working day within between the hours of 7am and 7pm.

Orders placed after 2pm during the week or at weekends are processed and dispatched the following working day. No orders are processed, despatched or delivered on Bank Holidays or weekends.

Please note that during busy periods delivery can take up to 3 working days. Payments by bank transfer can encounter delays in despatch.

Complaints

We welcome all feedback about our service and we aim to deal with any problems or difficulties experienced by our customers both quickly and fairly.

We have a simple but comprehensive returns and refunds policy which means that we can get to the bottom of most queries quickly and easily over the phone. For issues that cannot be dealt with immediately we will endeavour to respond within 24 hours either with a solution or with an expected timescale to put an end to the issue.

Returns and Refunds

We have a simple but comprehensive returns and refunds policy which means that we can get to the bottom of most queries quickly and easily over the phone. For issues that cannot be dealt with immediately we will endeavour to respond within 24 hours either with a solution or with an expected timescale to put an end to the issue.

Please note that we do not refund on sale merchandise.

We believe that you will be amazed with the products you purchase but understand that there may be an occasion where you feel it necessary to return an item. As part of our commitment to customer service, we aim to keep these instances to a minimum and the process as simple as possible. These terms do no affect your statutory rights.

Unwanted goods

If you return an unopened, unused product within 14 days of the date of purchase, we will refund you any money which you have paid us for that product. All you pay for is the return postage of the goods. Please contact us by email (info@inknails.com) to inform us that you wish to return the goods and we will allocate you with a returns code. To enable us to deal with your return as efficiently as possible, you will need to detail the returns code on any correspondence relating to the return procedure, including the package of returned goods. The period is 14 days as opposed to 30 days due to the nature of the goods being cosmetics/perishable and their need for temperature controlled environments

Faulty/Incorrect Goods

If you receive an item from us which is faulty/broken please contact us by email (info@inknails.com) to inform us within 7 days of purchase and we will arrange a refund or a replacement. In the event of you returning goods to us we will also pay you the cost of the return postage. Please contact us prior to returning the items and we will allocate you a returns code and we will advise you how to send or whether to send the items back to us. To enable us to deal with your return as efficiently as possible, you will need to detail the returns code on any correspondence relating to the return procedure, including the package of returned goods. Please note: there is a different procedure for each electrical item as well as certain other items we distribute so check below for information regarding specific items.

UV/LED Curable Professional Use Only Products: These include but are not limited to iLac (includes colour, base, base elevation, top plus and rock), xLac, Jelly Pro, iJel, Colour Gel Paint, Fluid Rubber (Flubber range) and 3D Colour Gel

The warranties on the above UV/LED curable products from the date of purchase are as follows:

iLac, xLac, Acrygel – 12 months

iJel/Jelly Pro/Fluid Rubber/3D Colour Gel/Colour Gel Paint – 24 months

The warranty is the minimum amount of time we guarantee the product and does not represent a best before warranty. They may be used indefinitely until such a time as polymerisation commences.

You will notice that the polish range (iLac & xLac) are guaranteed for only 12 months whereas the higher concentrated gel products are guaranteed for 24 months. iLac/xLac are hybrid polishes which means they are a fusion of traditional polish & gel, a formula that clearly sets us apart from other brands…no more gloopy, difficult to paint and impossible to remove old fashioned gel polishes. iLac & xLac paint like a nail polish, wear like a gel and remove in a fraction of the time it takes to remove a standard gel polish.

What about the 12 month warranty? It is not long enough!!! We guarantee for 12 months meaning that in this time if you have a polymerisation issue we will ask you for the reference and the batch number printed either on the side or on the base of the bottle. We will then check this against our batch samples to identify if the product is faulty (at which point a credit will be issued) or if it is due to the products storage/usage (which voids any warranty). This does not mean it will polymerise in 12 months but that we guarantee is for that amount of time. A polish may last 14 months or even 14 years, each and every colour from each and every batch is made up using a large group of ingredients that are then processed using a complex series of reactions to achieve the finished article. Samples from each batch are then tested using an accelerated stability test to confirm that they will indeed meet the minimum 12 month warranty. iLac & xLac are constantly under development with a view to further increasing stability, pigmentation, colours…basically, at INK, everything is under review and always will be. The brand that declares themselves ´kings of the world´ will not not be kings for long!

Please note: Always try to store UV/LED curable products in a cool place and away from direct sunlight/heat sources. Please also take extreme care during application to make sure the open product and brush (which contains product and is then stored back in the bottle in the case of polish) is kept away from your lamp whilst curing

´LUX48 & PLATINUM X LED CURING LAMPS (UK VERSION to a UK Address)´

If a fault develops with the lamp we will arrange a collection with DPD at our expense. Upon receipt of the lamp we will test and repair where possible the fault before thoroughly testing once again and despatching for delivery to you (again at our expense). Where the lamp cannot be repaired we will replace with a new lamp. It is crucial that you keep all parts of the lamp including the box, instructions, packaging and lead/adaptor. From the collection date agreed with you we will endeavour to have the lamp repaired and back with you within 3 working days. Please note: once we agree a collection date you must make sure someone is home to hand over the lamp to the courier as a failed collection carries a 15.00 GBP charge, failure to hand over the lamp on the agreed date will lead to you having to forward the lamp to us at YOUR EXPENSE, this is something we can arrange but the charge is 15.00 GBP. Alternatively should you find it more convenient to return the lamp to us we will refund the cost of postage up to a value of 10.00GBP. Once the lamp has been used and/or 7 days have passed from the date of purchase refunds are no longer possible as we are unable to re-sell the lamp as new.

The lamp itself is guaranteed for a period of 12 months from the date of purchase – Dropping, spillages of liquids, fire and general mis-use will invalidate the warranty.

If for example a replacement lamp is sent 6 months from the purchase date, the replacement lamp will have 6 months warranty not 12 months.

EXEMPTION: The Lead & Power Adaptor are guaranteed for a period of 3 months from the date of purchase. The 3 month guarantee will be invalid where signs of mis-use can be seen for example ´exposed wires/cables´. Please be careful when wrapping and transporting the power adaptor. Power adaptors and leads are available to purchase separately from the website at cost price. This is your lamp and lead so please treat them both with care

Approximately 50% of the lamps returned for repair do actually work fine, if we find that your returned lamp is in perfect working order we reserve the right charge for both the collection and re-delivery (total 25.00 GBP). Please be sure to only contact us once you are sure there is a fault and it is not hand placement by a client or perhaps the lead/adaptor is faulty

These are the terms under which we (INK) sell and you (the client) purchase the LUX48 & PLATINUM X LED Lamps. Please take extra care when transporting the lamp, especially the lead and adaptor, leads and adaptors that have been damaged cannot be replaced although we have made them available at cost for purchase.

LED Lamps: ´LUX48 & PLATINUM X LED CURING LAMP (UK VERSION/EU VERSION to a NON-UK Address)

The terms are same as the above section ´UK VERSION to a UK Address´ with the exception being that the lamp must be returned to us for repair at your expense. We also reserve the right to charge for re-delivery of the fixed/replacement lamp

 

´KOOL48 LED CURING LAMP (UK VERSION to a UK Address)´

 

If a fault develops with the lamp please contact us for a return authorisation code and return address details. The lamp must be returned to us in its original packaging at your expense* (box…so please do not disgard it) together with the original adaptor cable. Upon receipt of the lamp we will test the lamp and if we find it to be faulty and free from signs of misuse/damage we will despatch a replacement lamp within 2 working days. Lead adaptors are guaranteed for 3 months. These are the terms under which we (INK) sell and you (the client) purchase the KOOL48 lamp. Please take extra care when transporting the lamp, especially the lead/adaptor, lead/adaptors that have been damaged cannot be replaced although we have made them available at cost for purchase. Once the lamp has been used and/or 7 days have passed from the date of purchase refunds are no longer possible as we are unable to re-sell the lamp as new.

The lamp itself is guaranteed for a period of 12 months from the date of purchase – Dropping, spillages of liquids, fire and general mis-use will invalidate the warranty.

If for example a replacement lamp is sent 6 months from the purchase date, the replacement lamp will have 6 months warranty not 12 months.

*IF A FAULT DEVELOPS WITHIN 7 DAYS OF ORDERING THEN WE WILL REIMBURSE UP TO 8 GBP FOR RETURN POSTAGE

The 3 month guarantee will be invalid where signs of mis-use can be seen for example ´exposed wires/cables´. Please be careful when wrapping and transporting the power adaptor. Power adaptors and leads are available to purchase separately from the website at cost price. This is your lamp and lead so please treat them both with care

´KOOL48 LED CURING LAMP (UK VERSION/EU VERSION to a NON-UK Address)

 

The terms are same as the above section ´UK VERSION to a UK Address´ with the exception being that the lamp must be returned to us for repair at your expense. We also reserve the right to charge for re-delivery of the fixed/replacement lamp

 

INK K38 CLIP (UK VERSION to a UK Address):

PLEASE NOTE: USING AN ADAPTOR CABLE OTHER THAN THE ONE ISSUED WITH THE K38 WILL ´IMMEDIATELY INVALIDATE´ YOUR WARRANTY AND CAN BE POTENTIALLY DANGEROUS AS IT WILL OVERHEAT THE BATTERY POTENTIALLY RESULTING IN FIRE.

*Consumable/replaceable parts are not covered under the warranty. In the event of careless usage (eg spillage, dropping, dismantling of the unit personally) the warranty is voided

*Parts warranty is for 1 year (not including consumable/replaceable parts) from the date of purchase

*Labour warranty is covered for 1 year from the date of purchase

*If a fault develops within 7 days of purchase a replacement unit will be sent. After 7 days units cannot be refunded but will be repaired under the warranty policy.

*In the event that a repair is needed the client is responsible for sending the unit back to us in its original packaging (must include all parts, box, leads, adaptor) and will bear the cost of postage. Once repaired INK will cover the return (to client) postage costs. Loan units are not available. In most instances we will repair the unit within 3 working days but delays may occur if a specific non stock part is needed.

Please be careful when wrapping and transporting the power adaptor. The guarantee will be invalid where signs of mis-use can be seen for example ´exposed wires/cables´.

These are the terms under which we (INK) sell and you (the client) purchase the INK K38 CLIP

INK K38 CLIP (UK/EU Version to a non-UK address): The terms of the 1 year warranty are the same as the above section ´UK VERSION to a UK Address´ with the exception being that we reserve the right to charge for re-delivery of the fixed/replacement INK K38 CLIP

Brushes (All INK Brushes): Brushes are only guaranteed for the first 7 days after receipt, this is due to the high possibility of contamination

 

Wall racks: Wall Racks must be checked for transit damage upon delivery, if damage is detected please ask your delivery driver to note the damage on the delivery note.

You will be held responsible for the returned item(s) until they reach us. For your reference, we suggest that you use a secure delivery method that requires a signature on delivery.

Availability of Products

We try to keep inknails.com as up to date as possible but cannot guarantee that particular Product will always be available.

All offers are available while stocks last. If we are unable to supply a product you have ordered, we will substitute it for a similar product also providing compensation by way of a free product (chosen by the despatch team).

We try and offer you the best service we can. But we cannot promise that all our products and services will meet your requirements and we cannot guarantee that inknails.com will be fault free. If you find a fault, please let us know by contacting info@inknails.com

There will be some times when your access to the inknails.com website is restricted to allow for repairs, maintenance or improvements.

Liability of inknails.com (INK)

The INK website is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Internet. If we are informed of any inaccuracies in the material on inknails.com we will try to correct them as soon as we can.

In particular we are not liable to you for the following:

Incompatibility of inknails.com with any of your computer or telecommunications equipment or software

Technical problems or errors or interruptions of inknails.com

Inadequacy of inknails.com to meet your requirements

To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (included but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss or privacy or loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to inknails.com

Nothing in this paragraph applies to liability in respect of products sold through inknails.com

Nothing in these Terms and Conditions excludes liability for death or personal injury caused by our negligence or fraud.

Proprietary Rights

The content of inknails.com is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of inknails.com on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on inknails.com without written permission from us.

No license is granted to you in these Terms and Conditions to use any trademark or service marks of ´INK´ or its licensors including, without limitation, the trade marks, or service marks – INK London

Changes

We may update these Terms and Conditions from time to time and these changes will apply to the use of inknails.com If you do not wish to accept the new Terms and Conditions you should not continue to use inknails.com If you continue to use inknails.com after the date on which the change comes into effect, your use of inknails.com indicates your agreement to be bound by the new Terms and Conditions.

General

Please read the instructions, manuals and other user documentation that comes with your products carefully.

´INK´ may change or withdraw any part of inknails.com, or may refuse you access to the web site at any time if we consider it necessary.

´INK´may also terminate this Agreement and immediately remove, cancel or suspend access to and use of inknails.com upon breach of any part of these Terms whatsoever.

Termination shall be without prejudice to INK´s other rights.

´INK´ acts as principal on its own account and not as agent for you or any other person.

If ´INK´ does not enforce any provision of this agreement such will not be considered a continuing waiver.

In the event that any part of these Terms is held to be unenforceable, such part will at INK´s option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

These Terms constitute the full agreement between you and INK and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.

Use of INK and the inknails.com website and these terms are subject to the laws of England and the jurisdiction of the English Courts.
